1. Controller

2. General & legal bases

We process personal data only where necessary. Depending on the case, the legal bases are Art. 6(1)(a) GDPR (consent), (b) (initiating and performing a contract, e.g. a booking request) and (f) (legitimate interest in a secure, functioning website).

3. Server log files

When you access our pages, our hosting provider automatically collects information your browser transmits (server log files): browser type and version, operating system, referrer URL, host name, time of the request and the IP address. This serves technical provision and security (Art. 6(1)(f) GDPR) and is deleted after a short time.

4. Hosting

Our website is hosted by Netlify, Inc., San Francisco, USA. Netlify processes the data arising in the process (in particular the server log files mentioned above) on our behalf; a data processing agreement under Art. 28 GDPR is in place. As Netlify is based in the USA, data may be transferred to a third country; such transfers are safeguarded by the European Commission’s standard contractual clauses under Art. 46(2)(c) GDPR. 5. Cookies

We do not set any analytics or marketing cookies ourselves. There is no reach measurement and no tracking. Fonts are served from our own server; no connection to Google Fonts is made.

6. Contact form

The form on our contact page lets you write to us without obligation. It transmits the fields you fill in (name, email address and your message) along with the language version the enquiry came from. Submissions are received by the form service of our hosting provider Netlify (“Netlify Forms”), where the message is stored and from where it is emailed to us. The same statements on processing on our behalf and on third-country transfers as under section 4 apply. To fend off automated spam the form contains an additional field that is invisible to you; if a program fills it in, the message is discarded.

The legal basis is Art. 6(1)(b) GDPR where your enquiry concerns a booking or a contract, otherwise Art. 6(1)(f) GDPR (legitimate interest in responding to enquiries). We use your details solely to handle your enquiry and delete them as soon as they are no longer needed for that purpose and no statutory retention periods apply. You are of course still welcome to reach us directly by phone or email.

7. Booking tool (Smoobu)

To show availability and take bookings we embed the booking tool of our service provider Smoobu GmbH, Berlin, directly into our site. The booking tool loads when the page is opened; in the process data (including your IP address, browser information and the booking details you enter) is transferred to Smoobu, which may set its own cookies. The legal basis is Art. 6(1)(b) GDPR (initiating and performing a contract) together with our legitimate interest in a functioning availability and booking display under Art. 6(1)(f) GDPR. Where Smoobu processes data on our behalf, a data processing agreement under Art. 28 GDPR is in place. For details see smoobu.com/en/privacy-policy.

8. Airbnb

On our apartment pages we link to our Airbnb listings. No Airbnb content is embedded in our site — the rating display on this website is produced by us. Only when you actively click such a link do you leave our website, at which point Airbnb’s privacy terms apply (Airbnb Ireland UC); a transfer of data to third countries, including the USA, may occur.

9. Retention

We store personal data only for as long as necessary for the respective purposes or as required by statutory retention periods, after which it is deleted.

10. Your rights

You have the right to access, rectification, erasure, restriction of processing, data portability and objection. You may withdraw any consent given at any time with effect for the future.

You have the right to lodge a complaint with a data protection supervisory authority, for us in particular: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW), https://www.ldi.nrw.de/.

11. Changes to this policy

We update this privacy policy whenever changes to our processing or the legal situation make it necessary. The current version published here applies.
